Terms of Service

These Terms of Service govern your use of Cultivate Hours ("the Service"), operated by Cultivate Hours ("we," "us," or "our") and accessible at cultivatehours.com. By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. Description of Service
Cultivate Hours is a supervision hour tracking tool for pre-licensed mental health professionals. It allows users to log supervised clinical hours by category, track progress toward state pre-licensure requirements, generate hour reports, link with clinical supervisors, and store supervision-related documents.
2. Eligibility
You must be at least 18 years old to use the Service. The Service is intended for pre-licensed mental health professionals (including pre-licensed counselors, marriage and family therapists, social workers, and psychology trainees) and their licensed clinical supervisors. You are responsible for ensuring your use of the Service complies with your state licensing board's requirements.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us immediately if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Enter protected health information (PHI) or any patient-identifying information into the Service. Notes and log entries are for administrative tracking purposes only.
- Submit false or fabricated hour entries for use in licensure applications.
- Use the Service for any unlawful purpose or in violation of any professional licensing regulations.
- Attempt to access, tamper with, or disrupt the Service's systems or another user's account.
- Resell or sublicense access to the Service.
5. No Protected Health Information
The Service is not a HIPAA-covered entity and is not designed to store protected health information. You must not enter patient names, session details, diagnoses, or any other information that could identify a client. The "Notes" field in hour logs is intended solely for administrative notes about the supervision session, not clinical content.
6. Accuracy of Licensure Requirements
Hour requirements displayed in the Service are based on publicly available state licensing board rules and are provided as a convenience only. They may be incomplete or out of date. You are solely responsible for verifying the current requirements with your state licensing board before submitting any application. We make no representations that the requirements shown are accurate, current, or complete.
7. Supervisor Relationships and Shared Data
When you invite a supervisor and they accept, they will be able to view your logged hours, category totals, and any documents you upload to your shared document space. By sending an invitation, you consent to this access. You may remove a supervisor link at any time, which will end their access to your data going forward.
8. Subscriptions and Payment
Certain features (PDF export and supervisor signature requests) require an active paid subscription. Subscriptions are billed annually and processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring annual basis until you cancel.
You may cancel your subscription at any time from the Account section of the app. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial subscription periods unless required by applicable law.
9. Paid Subscription Required
All features of the Service, including hour logging, progress tracking, supervisor linking, document sharing, PDF export, and supervisor signature requests, require an active paid subscription. There is no free tier. Access to the Service is contingent on maintaining a valid subscription.
10. Intellectual Property
The Service and its original content, design, and code are owned by Cultivate Hours and protected by applicable intellectual property laws. You retain ownership of the data you enter into the Service. You grant us a limited license to store and process your data solely for the purpose of providing the Service to you.
11. Termination
You may delete your account at any time from the Account section of the app. Upon deletion, your data is permanently removed from our systems. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific feature will remain available. Hour tracking data stored in the Service should not be your only record; we recommend maintaining your own backup records.
13. Limitation of Liability
To the maximum extent permitted by law, Cultivate Hours shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of licensure opportunity, or lost profits, arising from your use of or inability to use the Service. Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
14. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
15. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
